BACKGROUND
The United Nations Human Settlements Programme, UN-HABITAT is the United Nations agency mandated by the UN General Assembly, to promote socially and environmentally sustainable towns and cities with the goal of providing adequate shelter for all.
UN-Habitat has initiated a process of strengthening its urban legal knowledge (‘ULK’). The agency has recently identified seven new focus areas, one of which is ‘urban land, legislation and governance’. The agency sees an important opportunity to influence member states’ and Habitat Agenda Partners’ (HAPs’) initiatives on developing new and transforming old urban legislation. In order to ensure that engagements with member states and partners move beyond the level of legal principle UN-Habitat has chosen to focus on a particular set of legal tools used to facilitate large-scale urban expansion, known as land readjustment/land pooling. By focusing on a specific set of tools it is possible to draw out the real potentials, limitations and impacts of urban legal tools. From this experience it is then possible to build a compelling argument for fundament urban legal change.
