Organizational Context

Background: UNDP is providing assistance to authorities in Somalia in a multi-year Rule of Law and Security (ROLS) Programme. The ROLS Programme has three main components: Access to Justice, Civilian Police and Community Safety/Armed Violence Reduction. The overall goal is to strengthen rule of law and security through the creation and development of competent police and Judiciary bolstered by initiatives to, control small arms and address causes of crime through our AVR project. With regards to rule of law, the Programme will continue its focus on matched progress in law enforcement, judiciary and custodial corps. Integral to this strategy is the recognition that when progress is lacking in one of these areas it has a detrimental effect on the sustainability of achievements in the others.

The Somali legal system consists of three different sources of law: customary, Shari’a and secular. The majority of cases are dealt with through the customary and Shari’a legal systems. The practice of these different sources of law has created inconsistency in the application of the rule of law in Somalia. Over the past several years, the Judiciary component has focused on strengthening the capacity of the formal secular justice system through training and infrastructure rehabilitation. While it will continue in this respect, it will also place greater emphasis on harmonizing the three sources of law in accordance with international human rights law principles with the ultimate aim of attaining a justice system that is fair and effective, ensures respect for human rights and delivers justice to all Somalis.

Critical to the attainment of “the rule of law” and security is the establishment of a competent judiciary. In order to obtain this the standard of legal education delivered by faculties needs to be improved and enhanced. Currently there are Universities of Hargeisa, Puntland State University & East African University (in Puntland) and Mogadishu University are tasked with delivering continuing legal education to the Judiciary.

UNDP is looking to hire a qualified international legal education advisor for 120 days to assist law faculties in Somalia to develop specific courses designed to enhance the skills and capacity of members of the Somali Judiciary. This will include the development of specific learning modules covering topics such as legal analysis, statutory analysis, drafting (including the drafting of legal memorandums) and the application of international human rights standards. The incumbent will be expected to develop these modules in cooperation with the Universities law faculty staff, develop all accompanying course materials and/or manuals and to mentor law lecturers to ensure the delivery of a high quality course. Finally the incumbent will be expected to develop a modality with which to qualitatively measure the usefulness or otherwise of these courses

Functions / Key Results Expected

Under the direct supervision of the Access to Justice Project Manager, the international consultant will perform duties and responsibilities in accordance with the objectives and activities in the work plan and other duties as requested by UNDP. The scope of the work will be:

  1. Undertake an assessment of the capacity of the law faculties (University of Hargeisa in “Somaliland”; East African University in “Puntland” and Mogadishu University) and the skills development needs of the Judiciary and make concrete recommendations for the type and content of advanced courses required and able to be taught. The content of courses should be agreed by the Deans of the respective law faculties, the Chief Justice, Minister of Justice and Attorney General. The content should not duplicate existing capacity development initiatives being planned or undertaken by other agencies;

  2. Following said assessment, prepare suitable curriculums in collaboration with law faculty staff; prepare modules for the purposes of improving the substantive skills of judges, prosecutors and Government legal advisors. These may include (but not be limited to) courses in legal and statutory analysis, legal drafting, including drafting of legal opinions and memorandums, and trial practice;

  3. In collaboration with the law faculties staff, prepare all necessary course materials, including handouts, for use by course participants and which will be later developed into “bench books” for serving judges, prosecutors and Government legal advisors;

  4. The Consultant will develop, organize and implement a training of trainers (ToT) course for law faculty lecturers to enable them to deliver the courses developed. The training should include how to develop monitoring and evaluation tools, such as pre- and post-course tests, in order to evaluate the usefulness or otherwise of each module.

  5. The Consultant will mentor, guide and assist law faculty staff in the delivery of the prepared courses to judges, prosecutors and Government legal advisors in “Somaliland” and “Puntland.”

A full-time translator will be provided, should one be required, whilst the Consultant is in Somalia. The Consultant will be expected to undertake a 4-day security training course before deployment to Somalia.

The consultant will be required to bring his/her own computer.

Monitoring and Progress controls

Evaluation of the IC contract will be made by the UNDP Access to Justice Project Manager against the benchmarks and deliverables set for the assignment of the consultant at the end of the contract duration.

Final product/deliverables

The Consultant will be paid according to mile-stones reached during the course of the Consultancy

1.Curriculum, course syllabus and course materials developed and agreed to by the Chief Justice, Minister of Justice, Attorney General and Deans of the relevant Law Faculties; 2.ToT curriculum developed and signed off by UNDP Project Manager; 3.ToT course delivered and end of training report signed off by the UNDP Project Manager; 4.End of course reports, including monitoring and evaluation tools and results, submitted and signed off by the UNDP Project Manager; 5.A final report indicating all milestones attained, achievements, challenges and recommendations for follow up actions from UNDP, the Somali authorities and university law faculties.

Review/approval time

Progressive monitoring will be carried out by the Access to Justice Project Manager. Payment will be on a proportional lump sum basis across the consultancy as agreed between the consultant and Project Manager with final payment upon the satisfactory conclusion of the assignment and delivery of the products described in III above.

Recruitment Qualifications

Education:
Advanced university degree in Law

Experience: Minimum of 7-10 years of professional experience in law; Experience in teaching and designing curriculums for undergraduate and graduate legal education; Knowledge of and experience in African and/or Islamic judicial systems is desirable; Able to work independently with efficiency and competence Able to work independently with efficiency and competence; Past experience in the UN is desirable but not a requirement Excellent written and oral skills.
