The Republic of Yemen has received a Grant from the International Development Association (IDA) to cover part of the cost of the Groundwater and Soil Conservation Project (GSCP) and intends to apply portion of the proceeds of the Grant for procurement of Individual Consultant for O&M on Spate Structures whose Terms of Reference are given below:
Responsibilities:
The main objectives of this assignment is to study the traditional practices existing in the past towards community O&M of spate schemes, gradual deterioration of these practices over the years and to develop an institutional framework that will ensure future O&M of the Spate Structures based on the participation of the Existing Community Organizations and / or the WUAs established under GSCP.
The selected Consultant will critically review all the relevant documents, and come up with practical suggestions of cost-sharing for O&M (in cash or in kind) within the framework of the provisions of the Water Law and other laws, how the O&M of spate schemes could be ensured by WUAs and other Community based Organizations (CBOs).
The responsibilities of the Consultant will include, but not limited to the following:
• Review all relevant documents, data, and articles on O&M of spate schemes in Yemen, including Water Law, its proposed Bye-laws, Cooperative Law, NGO Law for establishing WUA, Tripartite Agreements signed under GSCP for Spate schemes,
• Review O&M practices prevalent on various projects (e.g. IIP) and in provinces (for example the Lahej and Abyan Governorates which proposed levies for O&M of spate schemes), Traditional Practices of O&M of spate schemes, and current O&M situation of the spate schemes implemented in the past (e.g. schemes implemented under LWCP in Shabwa).
• Recommend practical suggestions of cost-sharing for O&M (in cash or in kind) within the framework of the provisions of Water law and other laws indicated above, how the O&M of Consultant will also recommend which kind and size of spate schemes should
• be provided O&M support by the Government and which by the WUAs;
• What kind of support in terms of equipment and training would be required for the WUAs to ensure their O&M activities.
• How the traditional practices of O&M of Spate Structures built by the projects can be strengthened (e.g. the beneficiary farmers generally maintain the canals which pass irrigate their lands, but the practice of O&M of the spate structure in the wadi has practically gone into disuse).
• To examine, in consultation with NWRA, whether the water bye-laws would provide authority for the WUAs to levy fee for O&M or fine for defaulters and assist these WUAs sustainable to undertake these activities.
• Although the Tripartite Agreements were signed with the beneficiaries for O&M of the Spate Structures implemented by GSCP, the adherence of the beneficiaries to the agreements is very essential and the expert must review and assess the reasons (if any) of beneficiaries for not adhering to the Tripartite Agreements.
• The expert should critically assess the willingness of the beneficiaries as well as their firm commitment to perform O&M from their own resources.
• To review the local traditional law of "Geberty" by which the O&M of the schemes was ensured, including the adherence / consensus of the farming communities to spate water distribution based on the "Geberty Law"
The Consultant should have a minimum of MSc in Agriculture/Agriculture Economics and an experience of not less than 10 years in institutional aspects related to the roles and functions of the farming community organizations and / or O&M of Spate Schemes .
The Consultant should be ready to make extensive field visits of the Governorates. GSCP will appoint a counterpart to work closely with the Consultant during the field as well as office work
Duration: three months
Interested consultants must provide their CVs indicating that they are qualified and would be available to perform the services.
